What Data We Collect and Why a) When you place an order We collect your name, email address, delivery address and payment information. This is necessary to process and fulfil your order. The legal basis is the performance of a contract (Article 6(1)(b) GDPR). Payment is processed securely by PayPal or your card provider. We do not store your full payment details. b) When you visit our website Our websites are hosted on Wix and Shopify. These platforms automatically collect technical data such as your IP address, browser type, pages visited and time spent. Wix uses standard analytics tools including Google Analytics to collect data on website traffic and usage. This data is collected and processed by Wix and Google on our behalf. We do not use any additional tracking or advertising pixels. c) When you sign up for our newsletter We use Pop Up by Smart Target, a Wix application, to invite visitors to subscribe to our newsletter. When you sign up, we collect your email address. This data is stored in our Wix contacts and used only to send you updates about The Muses. You can unsubscribe at any time via the link in every email. The legal basis is your consent (Article 6(1)(a) GDPR). d) When you contact us directly If you email us or submit a contact form, we collect your name and email address to respond to your enquiry. The legal basis is our legitimate interest in responding to customer communications (Article 6(1)(f) GDPR). 3. How Long We Keep Your Data We retain your data only for as long as necessary: Order data is kept for 10 years in accordance with German commercial and tax law. Newsletter subscriber data is kept until you unsubscribe. Customer service correspondence is kept for up to 3 years. 4. Who We Share Your Data With We do not sell your personal data. We share data only with third-party services necessary to operate our business: Shopify Inc. (e-commerce platform, servers in the US) — Shopify is certified under the EU-US Data Privacy Framework. Wix.com Ltd. (website hosting and CMS, servers in the US) — Wix is certified under the EU-US Data Privacy Framework. PayPal (payment processing) — subject to PayPal's own privacy policy. Shipping carriers (your name and delivery address are shared with the carrier to fulfil your order). 5. International Data Transfers Some of our service providers (including Shopify and Wix) process data outside the European Economic Area. Where this happens, we rely on appropriate safeguards such as EU Standard Contractual Clauses or adequacy decisions by the European Commission. 6. Your Rights Under the GDPR, you have the right to: Access the personal data we hold about you. Rectification of inaccurate or incomplete data. Erasure of your data where there is no legitimate reason for us to keep it. Restriction of processing in certain circumstances. Data portability where processing is based on consent or contract. The Muses VOF. themuses.studio / themuses.store 1. Scope and Contracting Party These Terms and Conditions apply to all purchases made through themuses.studio and themuses.store. The contracting party is The Muses VOF, registered in the Netherlands (KVK: 73455938), with registered office at Van Vreumingenstraat 10, 2801 AV Gouda, Netherlands. By placing an order, you agree to these terms. 2. Products We offer two types of products: Ready-made pieces: Finished items available for immediate purchase. Custom / made-to-order pieces: Items produced specifically to the customer's specifications. These are clearly labelled as such in the product listing. Pieces are handmade or upcycled in our Berlin studio in limited quantities. Product images are as accurate as possible, but slight variations in handmade items are normal and not considered defects. 3. Prices and Payment All prices are listed in Euros and include applicable VAT. Payment is processed securely at checkout. We accept: PayPal Credit and debit card Payment is due at the time of order. We reserve the right to cancel any order if payment cannot be confirmed. 4. Contract Formation A binding contract is formed when you complete checkout and receive an order confirmation from us. We reserve the right to decline orders at our discretion, for example in cases of pricing errors or stock issues. 5. Shipping All orders ship from Berlin, Germany. We pack every piece carefully and ship with reliable carriers. Processing time: usually 2 to 5 business days if product is in stock. Made-to-order products will vary but processing time is indicated in the product description. Shipping rates: calculated at checkout. Destinations: EU, Switzerland and the United Kingdom. Outside EU upon request and depending on the destination. Customs and import duties: Any customs duties, import taxes or local fees applicable to international orders are the responsibility of the customer. You will receive a tracking link as soon as your order has shipped. If you have a special shipping request, please get in touch before placing your order. 6. Right of Withdrawal If you are a consumer within the EU, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving a reason. To exercise your right of withdrawal, notify us within 14 days by email at julia@themuses.studio. You then have a further 14 days to return the item. Please note: The right of withdrawal does not apply to custom or made-to-order pieces produced specifically to your specifications (in accordance with § 312g Abs. 2 Nr. 1 BGB and Article 16(c) of the EU Consumer Rights Directive). These items are clearly labelled as custom or made-to-order. 7. Returns and Refunds Returns are accepted within 14 days of delivery. Items must be unused, in original condition and original packaging. Return shipping costs are the responsibility of the customer. Refunds are issued to the original payment method once the item has been received and inspected. Custom or made-to-order pieces are not eligible for return unless they arrive damaged or defective. If your item arrives damaged, please contact us within 48 hours with photos and we will find a solution. 8. Statutory Warranty You are entitled to statutory warranty rights under applicable law. In Germany and the EU, this means a two-year guarantee period from the date of delivery for defects present at the time of purchase. 9. Limitation of Liability We are not liable for indirect or consequential damages unless caused by wilful misconduct or gross negligence. Our liability for slight negligence is limited to foreseeable damages typical for this type of contract. Liability for personal injury, death or damage to health remains unlimited. 10. Data Protection We process your personal data in accordance with applicable data protection law, including the GDPR. Governing Law These Terms and Conditions are governed by Dutch law (as the company is registered in the Netherlands), without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence. 12. Dispute Resolution We are not obliged to participate in alternative dispute resolution proceedings before a consumer arbitration body, but we are always happy to resolve issues directly.
